Husband-and-Wife Lawyers Secure Record $20.5 Million Verdict in MedMal Case
A husband-and-wife lawyer team has secured the highest reported medical malpractice verdict in Pennsylvania's Lackawanna County Common Pleas Court since 1999, when the same pair earned that distinction. Jeffrey M. Kornblau and Lynn Sare Kornblau helped a couple and their son win $20.5 million against a doctor and a Scranton hospital for birth complications that ultimately led to brain injury and a diagnosis of cerebral palsy. Jeff Kornblau said most of the jury verdict was for the son's long-term care.

Calif. State Bar to Review Permanent Disbarment Proposal
California State Bar officials two years ago recommended that certain offenses should be grounds for a new, permanent disbarment. But the California Supreme Court met with State Bar officials last month and told them to limit lifetime banishment to the worst of the worst. So on Thursday, the State Bar Board of Governors' Committee on Regulation, Admissions and Discipline Oversight will take a look at a scaled-down proposal that would permit permanent disbarment only for lawyers disbarred for a second time.

Office Culture Can Determine Firm's Success
As a law office management consultant, Joel A. Rose has seen that a firm's culture can be one of its major strengths when it is consistent with current and long-term objectives. However, a culture that prevents a firm from meeting competitive threats, or adapting to changing economic environments, can lead to the firm's stagnation and decline, unless its partners make a conscious effort to change. Rose discusses the difficult process of effecting a firm's cultural change.

Solo Calls State Bar's Grievance Against Him 'Fascism'
A Texas criminal defense attorney challenging his conviction for contempt of court for making an obscene gesture during a March appearance before a judge faces a new hurdle: The State Bar of Texas has filed a grievance against him. The Bar-initiated grievance alleges that solo Adam Reposa's actions while representing his client in that court appearance, including arguing with his client over whether to take a plea deal, violated state professional conduct rules. Reposa calls the grievance "fascism."

How to Practice Law and Raise a Family
Has work-life balance become a modern myth? Law firm partner Miriam Benton Barish says we should do away with the phrase because it oversimplifies a complex concept and is misleading. Instead, Barish urges that attorneys be candid and forthcoming about what is required to have a challenging legal career, while being an involved parent: namely, boundless energy and commitment to both endeavors, and presence of mind. Barish provides practical tips to help navigate a demanding life.

Construction Firm Lays Off Nearly a Third of Its Associates
Stein, Ray & Harris, a construction law firm with 21 lawyers in Chicago, laid off nearly a third of its associates after construction litigation failed to increase as much as the firm expected this year, due to market uncertainty. The firm laid off four of its 14 associates this month, after hiring seven attorneys earlier this year in anticipation of an increase in construction litigation linked to the economic downturn, said partner Robert Harris. But the jump in such litigation "hasn't materialized."

Firm Sued for Offering Job to Judge While He Sat on One of Its Cases
Lawyers who engaged a retiring judge in discussions about a future business relationship while he was ruling in one of their cases have been sued for damages -- specifically, the other party's attorney fees. The suit against Herten, Burstein, Sheridan, Cevasco, Bottinelli, Litt & Harz and partner Thomas Herten claims that the firm's actions amounted to professional negligence, and advances a third-party legal malpractice cause of action. The suit seeks compensatory and punitive damages.

Small Firms Trim a Little, but Stay Optimistic
Leaders at smaller law firms say they're trimming costs, but the hatchet's staying in the shed -- for now. And while small firms are keeping retreats closer to home or eyeing operating costs more carefully, the turbulent economy is actually making some feel optimistic. Some managing partners say they're hoping that the economic downturn -- which is making some giant firms shudder -- will generate recruiting and business development opportunities, based partly on the appeal of small firms' lower rates.
